terms and conditions for the ordering and use of bouduar.com gift cards
I. Terminology
§ 1
Terms used in these Regulations shall mean:
1) Seller - Bouduar Martyna Sobiecka in Gdynia (81-402) at ul. bp. Dominik 16, registered in the Central Register of Business Activity and Information kept by the Minister of Economy, NIP 8771417914.
2) Gift Card - an electronic or paper form of a bearer value voucher issued by the Seller, stating the right of the user of the voucher to exchange it for goods in the online shop bouduar.com, with a specified expiry date, with electronically assigned information on the value of the voucher. The Gift Card is not a payment card, it is not an electronic money instrument within the meaning of the applicable legislation.
3. Customer - a natural person, legal person or organisational unit without legal personality acquiring a Gift Card from the Vendor.
4. User - any bearer of a Gift Card who is a natural person.
5. Usable Value - the amount assigned to the Gift Card up to which the User may purchase goods using the Gift Card in the bouduar.com online shop.
6 Transaction - an operation carried out with the Gift Card involving the exchange of the Gift Card for goods by reducing its value (Usable Value) by an amount corresponding to the value of the goods or services purchased by the User.
7. bouduar.com shop - an online shop operated at the url: www.bouduar.com enabling use of the Gift Card.
II. General provisions
§ 2
1 The bouduar.com Gift Card is national in scope and is used exclusively for Transactions in the bouduar.com online shop.
2 The Usable Value is determined individually by the Customer and Bouduar. Information on the Usable Value for a particular Gift Card is provided to the Customer together with the Gift Card.
(3) The Gift Card has a graphic design developed by the Seller. On the basis of a separate agreement, the graphic design may be adapted to the Customer's needs.
4 The Gift Card is not refundable or exchangeable for cash.
(5) The Gift Card is redeemable for goods during the period indicated on the Card. In the event that, despite the expiry of the validity period of the Gift Card, the Usable Value on the Gift Card remains unused, the User is not entitled to claim a refund of the money transferred to the Vendor.
(6) The Merchant shall not be liable for Gift Cards that are lost or damaged after they have been issued to the Customer. The Customer is entitled to report the loss or damage to the voucher in order to block it.
§ 3
1 The bouduar.com Gift Card is the property of the Seller.
(2) The Gift Cards may only be transferred to the Customer if the Gift Card is purchased and paid for at bouduar.com. The Customer has the right to transfer the Gift Card to any natural person of his/her choice - Gift Card Users.
(3) Bouduar shall not be liable for the consequences of the inability to redeem the Gift Card resulting from circumstances for which it is not responsible, in particular those resulting from the invalidity of the Gift Card or the loss of the Gift Card by its User.
4 Boduar is not a party to the legal relationship between the User and the Customer.
III. Ordering Gift Cards
§ 4
1 Bouduar undertakes to provide Gift Cards to the Customer in the quantity, form and value in accordance with the order placed.
(2) Bouduar will electronically confirm the order placed by the Customer with an indication of the lead time.
(3) Bouduar shall issue a VAT invoice / bill to the Customer for the services rendered to the Customer for an amount corresponding to the value of the Gift Cards ordered by the Customer, taking into account the discount granted.
4 Bouduar will deliver the Gift Cards ordered by the Customer to the address specified by the Customer by courier or registered post or by any other means agreed between the Customer and the Vendor at the Customer's expense. Gift Cards will only be issued to persons authorised by the Customer to receive the vouchers.
(5) Bouduar shall be obliged to deliver Gift Cards to the Customer in the quantity and value in accordance with the order placed, subject to payment by the Customer of the amount arising from the - VAT invoice / bill. Payment shall be understood as crediting Bouduar's bank account with the amount resulting from the issued VAT invoice / bill.
IV. Use of the Gift Card
§ 5
The Customer and the Gift Card User acknowledge that:
Only Gift Cards previously activated by the Customer will be redeemed.
2 The user of the Gift Card may use the voucher more than once from the time of its activation, during its validity period.
3 Bouduar, in order to protect the interests of the Customer or the Gift Card User and to protect Bouduar's legitimate interests, reserves the right to temporarily block the use of the Gift Card without prior notice to the Customer.
(4) The User redeems the Gift Card by entering the unique code located on the Gift Card in the shopping cart in the „Enter discount code” field and confirming it with the „check” button located next to the „Enter discount code” field in the bouduar.com online shop. The value of the shopping cart will be reduced by the Usable Value current on the date of the purchase on the Gift Card. The Transaction made is equivalent to the purchase of the goods.
5 The Gift Card is read only in an electronic environment, i.e. each transaction is subject to verification of its admissibility and the determination of the Usable Value.
6 The Gift Card is never redeemable for cash.
7 In the event that the value of the goods purchased by the User exceeds the Usable Value, the Transaction will be able to be completed on the condition that the User pays the difference in price by another form of payment accepted by the bouduar.com shop.
8 In the event that the value of the goods purchased by the User is less than the Usable Value of the Gift Card, the User shall not be entitled to a refund of the remaining funds. No amount can then be paid to the User as „change” or cash out after the Transaction.
9 The customer can only use one gift card per order. Gift cards cannot be combined.
10 The Gift Card may be used during the validity period stated on the card or until it is blocked as referred to in point 11 below.
In the event of loss of the Gift Card, it is possible to block it. The blocking is carried out by the Seller on the basis of a notification made by the User via the hotline 507 421 966 or an e-mail to: hello@bouduar.com. Bouduar is not responsible for Transactions made by Gift Card bearers prior to the notification. As a prerequisite for blocking the Gift Card, the User must provide the number of the discount code (shown on the Card).
12 A defective Gift Card may be replaced by Bouduar upon delivery of the defective copy by the Customer and payment of the fee specified by Bouduar for the issuance of a new Gift Card.
13. online shopyshop.bouduar.com has the right to refuse to redeem the Gift Card in the following cases:
a. The expiry date of the Gift Card,
b. insufficient funds - Usable Value - on the Gift Card
c. The occurrence of technical problems which make it impossible to redeem the Gift Card (e.g. blocking of the Gift Card, damage to the voucher to the extent that the data stored on the card cannot be read).
14 The redemption of a Gift Card by its User constitutes a valid Transaction even if the User comes into possession of the Gift Card in an unauthorised manner, unless the Gift Card, despite notification, is not blocked by the Merchant beforehand.
(15) The return by the User of goods or services purchased with the Gift Card is possible under the rules of the bouduar.com shop. Refunds for returned products are made electronically to the Gift Card in the form of a new Value to Use. The refund renews the validity of the Gift Card.
(16) In the event of problems in processing a Gift Card Transaction, the User shall report the above to Bouduar via the hotline 507 421 966 or by e-mail to: hello@bouduar.com.
(17) Complaints relating to the Gift Cards will be dealt with by bouduar in writing within 30 days of the date on which the Customer or User submits the complaint in writing. Complaints may be submitted in writing to the Seller's registered address.
V. Provisions
§ 6
(1) In matters not regulated by these Rules, the relevant provisions of the Civil Code shall apply.
(2) The Customer, by depositing money on the Gift Cards, and the User, by using the Gift Card, declares that he has read these Terms and Conditions, raises no objections to their contents and undertakes to abide by them.
(3) The content of these Terms and Conditions is available on the website at www.shop.bouudar.com/karty-podarunkowe. The Seller is obliged to provide the Customer / User with the Terms and Conditions in writing upon any written request.
(4) Bouduar reserves the right to make unilateral changes to the Terms and Conditions. Bouduar will inform about the changes well in advance on the shop.bouduar.com website at www.bouduar.com. Changes to the Terms and Conditions must not infringe the acquired rights of Customers or Users.
